Rules
§ 1.
[Definitions]
The terms used in these Regulations of the online store mean:
- Store owner - Gift Mall Sp. z o.o. with headquarters at 00-203 Warszawa, Ul. Bonifraterska 17, entered into the National Court Register under the KRS number 0000827394, NIP number 7010969605, REGON number 385511771, tel .: +48 226 022 051, email address: [email protected] ;
- Store - Gift Mall online store, which conducts retail sales via the Internet, on the basis of the Regulations;
- Regulations - Regulations of the Online Store, being an integral part of the Agreement, regulating the terms and conditions of ordering goods by the Customer via the Internet as part of the Store;
- Agreement - a sales contract is concluded between the Store Owner and the Customer, under which the Store Owner undertakes to transfer the ownership of the goods to the Customer and hand over the goods to the Customer, and the Customer undertakes to collect the goods and pay the Store Owner the price;
- Customer - a person who is a consumer within the meaning of art. 221 of the Civil Code, which purchases goods via the Store;
- Recipient of the Goods - a person who is not a Customer, who was indicated in the order placed by the Customer as the addressee of the ordered Goods;
- Website - www.giftmall.pl
- Goods - products that the Customer can order in the Store via the Website and then purchase on the basis of an Agreement concluded with the Store Owner;
- K.c. - the Act of April 23, 1964, the Civil Code (Journal of Laws of 2017, item 459, as amended);
- Business day - means every weekday, excluding Saturdays and public holidays;
- Act - the Act of 30 May 2014 on consumer rights (Journal of Laws of 2017, item 683, as amended).
- E-gift card - a gift card in an electronic form, sent to the e-mail address provided when placing the order.
§ 2.
[General provisions]
- The condition for concluding the Agreement is the acceptance of the Regulations by the Customer.
- The goods available in the Store are free from physical and legal defects. Each party to the Agreement is absolutely obliged to comply with the provisions of these Regulations. The content of the Regulations is available on the website.
- In matters not covered by the Regulations, the provisions of the Civil Code shall apply accordingly.
- To use the Website via the Internet, it is necessary to have a device that allows the use of Internet resources, an e-mail box and an Internet resource browser that allows displaying websites.
§ 3.
[Terms of purchase]
- The www.giftmall.pl online store sells goods via the Internet, orders are accepted on the website. Orders can be placed via the form available on the website.
- By placing an order, you accept the provisions of the Regulations.
- The information on the Store's website does not constitute an offer within the meaning of the provisions of the Civil Code, and therefore placing an order by the Customer does not mean the immediate conclusion of the Agreement. By completing the order form, the Customer submits an offer to buy a specific Good. The Agreement is concluded upon confirmation of the order by the Customer, subject to the content of § 4 sec. 3 and 5 of the Regulations.
- The information contained on the website next to the purchased Goods at the time of placing the order is binding for the Customer and the Store, in particular: price, characteristics of the Goods, their features and conditions of use.
- Oferta sklepu obowiązuje wyłącznie na terenie Rzeczypospolitej Polskiej, a zamówienia realizowane są wyłącznie na terenie Rzeczpospolitej Polskiej.
- The store's offer is valid only in the territory of the Republic of Poland, and orders are processed only in the territory of the Republic of Poland.
- The online store sells the following goods:
- a) E-Gift Cards with a nominal top-up amount from external producers;
- b) Muli giftmall e-cards.
§ 4.
[Confirmation and verification of orders]
- The condition for the order to be fulfilled is that the Customer provides data that allow the Customer to be verified. If the order is to be processed (sent) to the Recipient of the Good, the Customer is also obliged to provide the necessary data of the Recipient of the Good.
- From the moment the order is confirmed, its verification is carried out. Verification takes place by phone or via e-mail. Then the Gift Card is sent to the Recipient to the e-mail address provided.
- The store has the right to refuse to accept the order or limit the method of payment when the order raises reasonable doubts as to the truthfulness and reliability of the data provided or the method of payment. The store reserves that it is entitled to refuse to accept an order in particularly justified cases, including, inter alia, in the following cases:
- a) when the given Good is not in stock (in stock);
- b) the customer has provided incorrect or false data and it is not possible to verify it;
4. In the case referred to in paragraph. 3, the Store will provide information about the status of the order to the e-mail address provided by the Customer or will inform by phone at the number provided by the Customer, offering the Customer the possibility to:
- a) cancel the entire order with the obligation to return the price paid to the Customer;
- b) canceling the order in part with the obligation to return to the Customer the price paid for the unrealized part of the order.
5. The Store has the right to request the Customer to confirm the payment (e.g. account statement, payment confirmation, etc.), if there are grounds to believe that the Customer placed the order using someone else's payment cards or otherwise committed fraud. If the Customer does not provide documents confirming the payment, the Store has the right to suspend the delivery of the Goods to the Customer / Recipient. In this case, the delivery of the Goods to the Customer / Recipient takes place after the Store has checked the fact of making the payment for the order and the data Customer provided by him when placing an order on the website. The store has the right to refuse to sell the goods to the customer if, as a result of checking the payment or customer data, the store finds a violation of the payment procedure for the order or other violations of applicable law by the customer.
§ 5.
[Payment]
- The customer makes the payment by bank transfer to the bank account indicated by the Store or using the payment system available at giftmall.pl.
- The order will be processed provided that the ordered goods are in stock. Otherwise, the customer is informed about the situation and discussions are held on the further implementation of the order (extension of the implementation time or cancellation of the order). The content of § 4 applies accordingly.
- All prices in the online store are prices in PLN. Payments must be made in Polish zlotys (PLN).
§ 6.
[Delivery of goods]
- The ordered goods are sent by the Store via e-mail.
- The execution of the order begins when the payment is credited to the Store's bank account.
- Order processing time - immediately from the moment of receiving the payment. In exceptional cases, the order processing time may be extended, about which the customer will be informed by phone or via e-mail.
- The order is sent to the e-mail address indicated in the form as the delivery address. It is not possible to change the address after making the payment in accordance with the content of paragraph 2.
- If the Customer provides an incorrect or inaccurate address, the Store is not responsible for non-delivery or delay in delivering the subject of the order.
§ 7.
[Returns and complaints]
- All Goods offered by the Store are new, free from physical and legal defects.
- Due to the security of activation codes for all gift cards available in the giftmall catalog, it is not possible to return. All questions regarding complaints/returns/exchanges of goods can be directed to [email protected]., and by phone: +48 226 022 051.
§ 8.
[Personal data protection]
- By placing an order in the Store www.giftmall.pl, the Customer acknowledges that his personal data will be placed in the database of Gift Mall Sp. z o.o. and processed for the purposes of concluding the contract and performing the order.
- Providing personal data by the Customer is voluntary, but the lack of consent to their processing prevents the Store from completing the order. The customer is responsible for providing false personal data.
- The administrator of personal data is Gift Mall Sp. z o.o. with its seat in Warsaw (Ul. Bonifraterska 17, 00-203, Warsaw). Providing data is voluntary, but necessary for the conclusion and implementation of the order.
- Customers' personal data is processed in order to carry out the activities necessary to complete the order by the giftmall.pl store, pursuant to art. 6 sec. 1 point b) of the General Data Protection Regulation of 27 April 2016 and in accordance with its content.
- The recipient of Customers' personal data will be Gift Mall Sp. z o.o. with its seat in Warsaw (Ul. Bonifraterska 17, 00-203, Warsaw). Customers' personal data will be kept for the duration of the contract and the performance of the order and after its termination or expiry for the period necessary to complete the performance of all obligations of the parties under the contract and the performance of the order.
- The customer has the right to access their data and the right to rectify, delete, limit processing, the right to transfer data, the right to object, the right to withdraw consent at any time without affecting the lawfulness of processing (if the processing takes place on the basis of consent) which was made on the basis of consent before its withdrawal.
- Providing personal data by the Customer is a condition for the conclusion of the contract and the implementation of the order. The customer is obliged to provide them, and the consequence of not providing personal data will be the inability to conclude and execute the order. Detailed provisions regarding the protection of personal data are also included in the Store's Privacy Policy.
§ 9.
[Multi Gift Card giftmall]
- The issuer of the Multi giftmall Gift Card is Gift Mall Sp. z o. o. with headquarters in Warsaw 00-203, Ul. Bonifraterska 17, entered into the National Court Register under the number KRS 0000827394.
- The Multi Gift Card is valid for a period of 24 months from the date of purchase, i.e. it is exchangeable for third-party Gift Cards available in the giftmall catalog during the period specified by the Publisher. After the period of validity, the Multi Gift Card will be forfeited.
- The Multi Gift Card can be redeemed only in the giftmall.pl online store by exchanging the brands from the catalog for Gift Cards up to the value of the funds accumulated on the Card.
- The value of the Gift Card is expressed in Polish zlotys (PLN) and is the maximum value of the goods or services that can be purchased by the Holder. The Multi Gift Card is not redeemable for cash.
- The Multi Gift Card can be used partially until the funds available on the Card are exhausted.
- If the value of the purchased Cards exceeds the value of the funds on the Multi Gift Card, the Customer is obliged to pay the price difference using the available payment methods.
- If the value of the purchased Cards is lower than the value of the funds on the Multi Gift Card, the Customer is not entitled to receive the rest.
- The Multi Gift Card is non-personal and may be transferred to third parties.
- The use of Gift Cards of third party Suppliers is in accordance with the terms and conditions of use of Suppliers.
§ 10.
[Final Provisions]
- The Regulations come into force on the day of publication on the Website.
- The Store reserves the right to amend the Regulations, which shall enter into force on the date of their publication on the Website.
- Agreements concluded before the amendment to the Regulations shall be governed by the version of the Regulations in force on the date of placing the order by the Customer.
